ADULTERY AND SEX OUTSIDE OF MARRIAGE

Adultery is an offence under Articles 282–284 of the Penal Code, with a penalty of one to three years imprisonment:

 The law penalizes the crime of adultery if the complaint is made by the husband or wife if they are married or by a woman’s guardian if she is unmarried.[NM1]

 The right to pursue a claim ends three months after the date of the complainant’s knowledge.

 The penalty shall be severe (mushadad) if adultery is committed in the marital home.

However, consensual sex between an adult man and adult woman neither of whom are married is not criminalized. [TW2]

Under the penal code, it can be penalized in the following cases:

 If a guardian or relative to the 4th degree (parent’s cousins or in-laws’ relatives) files charges of adultery against either party.

 An adult woman can file charges if the consensual sex was due to false promises of marriage.

[NM1] If she is unmarried but engaged? No adultery if you are not married!!

[TW2] It should be mentioned that under the Penal Code this can be penalized in the following cases:

 If a guardian or relative to the 4th degree files charges of adultery against either party.

 An adult woman can file charges if the consensual sex was due to false promises of marriage.
